After a period of technical development and engineering design, Sanliushi Solar applied for PCT patent protection to the World Intellectual Property Organization. In April 2021, the company’s PCT application was made public internationally, giving Sanliushi the choice of which countries and jurisdictions to file patent applications with local patent offices by April 2022. In March and April 2022, Sanliushi filed patent applications in every market where the company expects to operate commercially in the next few years, including the United States, Canada, the European Union and other countries.
Thirty Sixty Solar has received notification from ARIPO that the organization has completed a preliminary review of the company’s patent application. Based on their review, the four main claims distinguishing between thirty and sixty solar technologies all pass three patentability tests; the claims are novel, inventive and have industrial applicability. These three patentability tests are the same ones considered in all jurisdictions in which the thirty or sixty applicants for patent protection each require a similar global search of prior art. Companies are encouraged that the USPTO and other patent offices will reach the same positive conclusions as ARIPO regarding the patentability of principal claims.
The company’s original application contained several broader claims that must now be narrowed down to focus on the four novel and inventive claims of the patent application in order to pass secondary examination and grant. Thirty Sixty expects to file these amended claims in the coming weeks, focusing on patentable claims, well ahead of the June response deadline set by ARIPO.
